Frequently Asked Questions
A public adjuster is a licensed professional who represents the policyholder — not the insurance company — in the insurance claims process. Under Florida Statute 626.854, public adjusters are licensed by the Florida Department of Financial Services and are legally authorized to inspect damage, prepare claims documentation, and negotiate settlements on your behalf. Insurance company adjusters, by contrast, work for and represent the interests of the insurer.
Public adjusters in Florida work on a contingency basis, meaning there are no upfront fees. Per Florida Statute 626.854, our compensation is a percentage of the claim settlement. For non-emergency claims, the fee may not exceed 10% of the amount recovered. For claims related to a state of emergency declared by the Governor, the fee may not exceed 10% for claims filed within one year, and special rules apply for supplemental claims. All fee terms are disclosed in the written contract before services begin.
You may benefit from a public adjuster at any point in the claims process — whether your claim is new, has been underpaid, or has been denied. The earlier we are engaged, the more effectively we can document and present your claim. Florida law provides policyholders with certain time limitations for filing and pursuing claims, so contacting us promptly is advisable.
Yes. Care Claims Adjusting is licensed by the Florida Department of Financial Services as a Public Adjuster Firm (Firm #G114979). Under Florida law, you have the right to: hire a public adjuster of your choosing to represent you; receive a written estimate from your insurance company; receive payment on covered claims within the timeframes specified by Florida Statute 627.70131; invoke the appraisal process if you dispute the amount of loss; and cancel a public adjuster contract within a specified period as outlined in the contract. We ensure all of these rights are explained to you before we begin work.
